Terms & Conditions 2017
1. Registration and Payment:
1.1. In order to reserve a place in a lesson the lesson fee must be paid. Until we receive these monies we will not reserve a place for you.
1.2. The fee for each lesson, of either English Pronunciation Lesson or Pronunciation for Fluency is £6. The fee for  English Pronunciation Lesson PLUS or Pronunciation for Fluency PLUS is £8.
1.3.The fee for any other class, including one to one will be agreed upon by both the student and the teacher.
1.4 Payment can be made by cash, bank transfer or PayPal. PayPal includes payment made via the Meetup.com website.
1.5. Students making a payment for a minimum of 5 group PLUS classes in advance will be charged at lower rate of £7 per lesson. The minimum single payment at this rate is therefore £35 for 5 lessons.
1.6. The minimum age for attendance is 16 and for those students aged 16 and 17 we proceed on the basis that the parent, guardian of the student under 18 is aware of attendance and is bound by all the terms and conditions set out in this document in lieu of the student.

2. Data
2.1. As a part of the booking process we may ask students to disclose to us certain personal details. This will usually be the student’s full name, phone number and email address, and it is not disclosed to any third parties without the students’ consent.
3. Refunds
3.1. The student will be entitled to a full refund in the event that the lesson is cancelled by the teacher. The student will be asked if they would prefer a refund or to use their credit for another lesson.
3.2. Refunds may take up to two (02) weeks from the date when the requisite paperwork is complete.
3.3. If you have requested a refund and it is declined & you are not satisfied with our decision you can email: englishtjames@gmail.com stating the reasons for your complaint.

4. Flexibility
4.1. We reserve the right to change teachers, times of lessons and location of courses and to combine classes if:
4.1.1. Numbers for any particular class are low (3 students or less).
4.1.2. The location is unsuitable for teaching that day.
4.1.3. The teacher is sick.

5.Student Cancellations
5.1.Students are permitted to change the time or date of their class to another time during that same week. Providing they give 24 hours’ notice, their credit will be transferred to another class during that same week.
5.2.Students are permitted to transfer their payment to another class no more than twice during the same week.
5.3.In the event that a student has paid for lessons over a period of more than a week and they wish to change the time or date of a class during the coming weeks, providing they give 5 days’ notice, their credit will be transferred to another class during that same month.
5.4.Students are permitted to transfer their payment to another class no more than four times during that same month.

6. Studies
6.1. The maximum class size is 8.
6.2. There may be occasions when classes temporarily exceed this number before students.
6.3. Each class (1.15 hours duration) is followed by a break of 15 minutes. Breaks for evening classes (when available), specific classes and one to one classes may differ.
6.4. Please note that we accept new students every day so the composition of each class changes from day to day.
6.5. We invite the students to share any comments or feedback.
6.6. We will not review any feedback or response we receive after the class in question has been concluded. Students must raise any issues with us as and when they appear.
6.7. We reserve the right to cancel a student’s booking in the event of conduct or behaviour which in our opinion diminishes (or may diminish) the reputation of the group, even if such conduct is not in breach of these terms and conditions.
6.8. Students must contact the teacher in the event that they are unable to attend their class. Students are advised to use the method of booking to make contact with their teacher or refer to the website for contact details.
6.9. The intellectual property pertaining to our course hand outs and other teaching materials is owned by us and the students agree not to copy or reproduce the materials for commercial benefit. Students further agree not to access illegally copied and stored versions of any published material and to do so may put in jeopardy their place on the course.
6.10. Students must:
6.11. Only speak English in their class.
6.12. Inform us if they cannot attend a class for any reason.

7. Disability Policy
English Teacher James does not discriminate against anyone in terms of any physical or learning disability. If students reveal any of these issues during the booking process they are made aware of the limitations to what can be provided due to the nature of the building and the resources at the school’s disposal as follows:
7.1. All students must be able to negotiate stairs unaided. There are no lifts taking students all the way to the usual place of study and students may need to walk down 1 flight of stairs.
7.2. We do not currently have any provision for students with hearing difficulties in terms of induction loops.
7.3. Materials can be amended to aid students with visual impairment to a certain extent though they would still need to be able to negotiate the building unaided, though guide dogs are admitted.
7.4. Students with learning difficulties such as dyslexia and dyspraxia are admitted.
7.5. If students reveal any health issues which may impede their performance on the course or their ability to complete the course we will make them aware of our attendance and refund policy.

8. Liability
8.1. Save for death or personal injury caused by our negligence we exclude to the extent permitted by law all conditions, warranties and other terms which might be implied by statute, common law or equity any liability for any direct, indirect or consequential loss or damage of any kind, howsoever arising and whether caused by tort (including our negligence), breach of contract or otherwise even if such loss is foreseeable.
8.2. The provisions of clause 8.1 do not extend to any liability to students arising out of any fraudulent misrepresentation made by us or our employees or agents.
8.3. Subject to the provisions of clause 8.1 all activity undertaken by a student is strictly at the student’s own risk and we take no responsibility. This includes any activities where our employee is present as a guide or facilitator.
8.4. It remains each student’s responsibility to safeguard their property and consider whether insurance is required.
8.5. We shall take all responsible steps to fulfil student expectations regarding the course but we do reserve the right to alter services to at least an equivalent standard at no additional cost.
8.6. While we take all reasonable steps to ensure the information contained in our brochures and website is accurate, we reserve the right to alter this, substitute or withdraw any amenity without further notice.
8.7. Should any of the following events occur then we will not be liable to provide further services:
8.7.1. Strikes.
8.7.2. Industrial action.
8.7.3. Fire.
8.7.4. Civil unrest.
8.7.5. Acts of God.
8.7.6. Legal action.
8.7.7. Withdrawal of regulatory consents.

9. Photography.
9.1.Sometimes English Teacher James or our representatives take photographs and videos during our courses which may be used for promotional purposes. Please advise us at the time of booking if you do not wish to appear in any promotional material.
